Terms of Service for BITBI
Effective date: May 5, 2026
These terms apply to using BITBI, purchasing and using credits, saved assets, publication features, and AI-supported generation tools.
1. Provider and Scope
BITBI is an online service for AI-supported creation, management, and publication of digital content such as images, videos, music, text, and other media. These terms apply to bitbi.ai, user accounts, credit packs, generative AI features, saved content, and publicly published content.
Different terms from users do not apply unless BITBI expressly agrees to them in writing.
2. User Account and Registration
Certain functions, especially purchasing and using credits, require a registered user account. Users must provide accurate, complete, and current information and keep access credentials confidential.
Users are responsible for actions performed through their account where they are responsible for those actions. BITBI may temporarily restrict or permanently close accounts where misuse, legal violations, payment fraud, security risks, or material breaches of these terms are suspected.
3. BITBI Services
BITBI provides tools for creating, editing, storing, and publishing digital content. Features may evolve, change, expand, or be discontinued.
Individual functions may depend on third-party providers, AI models, cloud services, payment providers, or technical interfaces. Unless expressly promised otherwise, no specific availability, model version, quality, speed, or result is guaranteed.
4. Credits
Credits are digital usage units for paid AI functions. Credits are not e-money, a bank balance, transferable, interest-bearing, or redeemable for cash except where mandatory law requires otherwise.
The number of credits required for a function may vary depending on model, quality, resolution, reference images, length, compute effort, or provider costs. BITBI may adjust credit costs for future use. Completed purchases remain unaffected.
Subscription credits and one-time purchased credits are tracked separately. A BITBI Pro subscription provides a monthly subscription credit allowance that is topped up to 6000 subscription credits for the paid period and does not accumulate beyond that subscription allowance. One-time purchased credits remain additional and separate.
5. Buying Credits and Payment Processing
Credits can be purchased only by registered users. Payments are processed by Stripe or another indicated payment provider. Users enter payment details directly with the payment provider. BITBI does not store full card details.
Credits are generally added after successful payment confirmation. In cases of chargebacks, suspected fraud, unauthorized payments, or misuse, BITBI may block credits, reverse credits, or temporarily restrict an account.
BITBI Pro is a monthly subscription billed through the indicated payment provider. Subscription benefits are provisioned only after verified payment confirmation. If a subscription is cancelled, access to the paid subscription period continues until the end of that period unless mandatory law or payment-provider rules require otherwise.
6. Prices and Taxes
The prices shown at the time of purchase apply. Prices may include or show VAT or other charges where applicable. BITBI may change prices and credit packs for future purchases.
7. Withdrawal and Digital Services
Consumers may have statutory withdrawal rights. When purchasing digital credits, users may expressly request that BITBI begin providing the credits before a withdrawal period ends.
Where legally permitted, the withdrawal right may expire once credits are provided or used if the user has expressly consented and acknowledged the possible expiration of the withdrawal right beforehand.
The same principles can apply to subscription credits and other immediately provided digital subscription benefits where the user requests immediate provision and acknowledges the possible legal consequences before checkout.
Unused credits are refundable only where required by law or where BITBI voluntarily agrees in an individual case.
8. User Content, Prompts, and Reference Material
Users are solely responsible for text inputs, prompts, images, videos, music, files, reference images, and other content they upload, enter, save, or publish.
Users confirm that they hold all necessary rights and do not infringe third-party rights, including copyrights, trademarks, personality rights, privacy rights, or rights in one's own image.
Users may not upload or generate content that is unlawful, offensive, discriminatory, pornographic, glorifies violence, endangers minors, is fraudulent, or is otherwise abusive.
9. AI Outputs and Responsibility
AI-generated results can be inaccurate, faulty, similar to existing works, unexpected, incomplete, or legally problematic. BITBI does not warrant that an AI output is suitable for a particular purpose, legally usable, unique, free of third-party rights, or commercially exploitable.
Users are responsible for reviewing AI outputs before using, publishing, or commercially exploiting them.
10. Rights in Content
To the extent legally possible, rights in content submitted by users remain with the users. Users grant BITBI the rights necessary to technically process, store, transmit, send to AI or infrastructure providers, display, publish, secure, and provide the services.
For publicly published content, users also grant BITBI the right to display that content and make it publicly accessible within the platform.
BITBI does not claim broader ownership of user content.
11. Prohibited Use
Users may not use BITBI to create unlawful content, infringe third-party rights, endanger minors, distribute fraudulent or misleading content, bypass security mechanisms, abuse automation, scrape systems, overload systems, introduce malware, or misuse AI functions to develop competing models or services.
BITBI may remove content, block generations, freeze credits, or restrict accounts where a violation is suspected.
12. Publication and Community Features
When users make content public, it is visible to others and may be shared, saved, or referenced. Users are responsible for publication decisions.
BITBI may moderate, remove, or limit visibility of published content where legal risks, rights violations, misuse, or breaches of these terms exist.
13. Third Parties and External Services
BITBI uses third parties such as payment processors, cloud infrastructure, AI model providers, email services, analytics, security, and payment services. Their own terms and privacy notices may also apply.
BITBI is not responsible for outages, changes, or decisions of third parties unless BITBI is legally responsible for them.
14. Availability and Changes
BITBI aims to provide stable availability but does not owe uninterrupted operation. Maintenance, security measures, technical incidents, third-party outages, overload, or force majeure may restrict use.
BITBI may change functions, models, credit costs, storage limits, upload limits, and security rules where technical, economic, legal, or security reasons require it.
15. Warranty
Statutory warranty rights apply where they cannot be validly restricted. For free or experimental functions, BITBI does not provide a quality guarantee.
AI features are provided as creative and experimental tools; specific results are not guaranteed.
16. Liability
BITBI has unlimited liability for intent and gross negligence, injury to life, body, or health, and under mandatory statutory provisions.
For slight negligence, BITBI is liable only for breaches of essential contractual obligations and limited to foreseeable, contract-typical damage.
Liability for lost profits, indirect damage, data loss, rights violations caused by user content, unchecked AI outputs, or third-party outages is excluded to the extent legally permitted.
17. Indemnification
Users indemnify BITBI against third-party claims arising from user uploads, publications, use of AI outputs, violations of third-party rights, legal violations, or breaches of these terms.
This includes reasonable legal defense costs where the user is responsible for the violation.
18. Term, Restriction, and Termination
Users may end their account through available account functions or by contacting BITBI.
BITBI may restrict or terminate accounts where material breaches, misuse, payment fraud, security risks, or legal obligations require it.
When an account is deleted, stored content and unused credits may be deleted or blocked to the extent legally permitted.
19. Privacy
Personal data processing is described in BITBI's Privacy Policy. Payment data is generally processed by Stripe. Users should review the Privacy Policy and cookie notices.
20. Changes to These Terms
BITBI may change these terms where legal, technical, economic, or functional changes require it.
Users will be informed of material changes in an appropriate way. Where legally required, renewed consent will be requested.
21. Final Provisions
German law applies unless mandatory consumer protection rules in the user's country of residence override it.
If one provision of these terms is invalid, the remaining provisions remain effective.
The place of jurisdiction is the provider's registered seat only where legally permitted.
